1. Agreement to Terms
By accessing or using Aura'd ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations.
2. Description of Service
Aura'd provides a salon booking platform that enables:
- Salon Owners/Professionals: To manage appointments, services, availability, and accept bookings from clients
- Clients: To discover, book, and pay for salon services
The Service includes our website, mobile applications, and related features and functionality.
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised use
3.2 Account Types
- Client Accounts: For individuals booking salon services
- Business Accounts: For salon owners and beauty professionals providing services
4. Booking and Payment Terms
4.1 For Clients
- Bookings are subject to salon availability and acceptance
- You agree to attend booked appointments or cancel within the salon's cancellation policy
- Payment is processed securely through our payment provider (Stripe)
- Refunds are subject to the individual salon's cancellation policy
4.2 For Salon Owners
- You are responsible for honouring confirmed bookings
- You must provide accurate service descriptions, pricing, and availability
- You are responsible for the quality of services provided
- You must comply with all applicable laws and regulations
4.3 Fees and Payments
- Commission: Aura'd charges zero commission on bookings
- Subscription Fees: Business accounts may be subject to monthly subscription fees as per the chosen plan
- Transaction Fees: Card processing fees (1.9% + 20p) apply to payments processed through the platform
- Payouts: Salon earnings are transferred to the connected bank account according to the Stripe payout schedule
5. Cancellation and Refunds
5.1 Appointment Cancellations
- Clients may cancel appointments according to the salon's cancellation policy
- Late cancellations or no-shows may result in charges as per salon policy
- Salons may cancel appointments with reasonable notice
5.2 Subscription Cancellations
- Business subscriptions can be cancelled at any time
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial billing periods
6. User Conduct
You agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Post false, misleading, or fraudulent content
- Interfere with or disrupt the Service
- Attempt to gain unauthorised access to any part of the Service
- Use automated systems to access the Service without permission
- Collect user information without consent
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Aura'd and are protected by international copyright, trademark, and other intellectual property laws.
- You may not copy, modify, or distribute our content without permission
- You retain ownership of content you post (service descriptions, photos, etc.)
- By posting content, you grant us a licence to use it in connection with the Service
8. Third-Party Services
The Service integrates with third-party services including:
- Stripe: For payment processing
- Email/SMS Providers: For notifications and reminders
Your use of these services is subject to their respective terms and privacy policies.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
- We are not responsible for the quality of services provided by salons using our platform
11. Indemnification
You agree to indemnify and hold harmless Aura'd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Services provided through the platform (for salon owners)
12. Termination
We may terminate or suspend your account and access to the Service:
- For violations of these Terms
- For fraudulent or illegal activity
- At our sole discretion with notice
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
13. Dispute Resolution
13.1 Between Users
Disputes between clients and salons should be resolved directly between the parties. Aura'd may facilitate communication but is not responsible for resolving disputes.
13.2 With Aura'd
Any disputes arising from these Terms shall be:
- First attempted to be resolved through informal negotiation
- Subject to the exclusive jurisdiction of the courts of England and Wales
- Governed by the laws of England and Wales
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending email notification for significant changes
Your continued use of the Service after changes constitutes acceptance of the new Terms.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Aura'd
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- Waiver: Failure to enforce any right does not constitute a waiver
- Assignment: You may not assign your rights without our consent
